1. About us
This website, qaadir.me, is operated by Qaadir Assistive Technology FZ LLC, a company licensed in the Ras Al Khaimah Economic Zone (RAKEZ), United Arab Emirates, trade licence number 7020355, VAT TRN 105573558100003 ("Qaadir", "we", "us", "our"). Our address is Compass Building, Al Marjan Island, Ras Al Khaimah, United Arab Emirates. You can contact us at support@qaadir.me or +971 54 452 4679.
2. Who these terms apply to
We supply orthotic, prosthetic, podiatry and rehabilitation products, materials, equipment and software to businesses and professionals, including clinics, hospitals, rehabilitation centres, workshops, distributors and public bodies. These terms apply to every use of this website and to every quote, order and sale between you and us, unless we agree different terms in writing. By using this website or placing an order, you confirm that you act for a business or professional purpose and have authority to bind the organisation you represent.
3. Quotes and orders
Quotes are valid for 30 days unless they state otherwise. An order becomes a contract only when we confirm it in writing (including by email) or dispatch the goods. We may decline any order, including where products are unavailable, where an order may breach applicable law, export controls or sanctions, or where we cannot verify the buyer. If a price or description on the website contains an error, we will tell you before confirming the order.
4. Prices and payment
Prices are shown in the currency selected on the website and are Ex Works, Ras Al Khaimah Economic Zone, unless your quote states otherwise. Prices exclude freight, insurance, import duties, taxes and installation unless stated. UAE VAT is charged where it applies. Unless we have agreed credit terms with you in writing, payment is due in full before dispatch. Where credit terms are agreed, overdue amounts may lead us to suspend further deliveries until they are paid.
5. Delivery and risk
Delivery, lead times and freight are set out in our Shipping policy and your quote. Delivery dates are estimates. Risk in the goods passes to you as set out in the agreed Incoterm (Incoterms 2020), or on collection or delivery if no Incoterm is agreed.
6. Ownership
Ownership of goods passes to you when we have received payment in full.
7. Product information and professional use
Product descriptions, images and specifications are provided in good faith from manufacturers' information and may change. Many of our products are medical devices or components intended to be prescribed, fitted, fabricated or used only by suitably qualified professionals, in line with the manufacturer's instructions for use. You are responsible for clinical decisions, for selecting suitable products for each patient, and for obtaining any registration, licence or approval required to import, sell or use the products in your country, unless we agree in writing to do so.
8. Warranty
Products are covered by the manufacturer's warranty, the terms of which we will provide on request. We will manage warranty claims with the manufacturer on your behalf. Warranties do not cover wear and tear, misuse, incorrect installation or fitting by others, unauthorised modification, or failure to follow the manufacturer's instructions. Except as set out in these terms or required by law, we give no other warranties about the products.
9. Returns
Returns, damaged items and refunds are covered by our Returns policy.
10. Installation and training
Where installation or training is included in your order, we will agree dates with you. You must provide safe access, a suitable site and the power, air, extraction and other services set out in the equipment's site requirements. Extra visits caused by an unprepared site may be charged.
11. Liability
We are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, data or goodwill. Our total liability arising from any order is limited to the price paid for the products or services concerned. Nothing in these terms limits liability that cannot be limited under the laws of the United Arab Emirates.
12. Export controls and sanctions
You agree not to export, re-export or supply any product in breach of applicable export control or sanctions laws, and to provide end-user information if we reasonably request it.
13. Using this website
You may use this website for lawful business purposes only. You must not interfere with its security or operation, introduce malicious code, or copy, scrape or reuse its content without our written permission. Text, images, logos and other content on this website belong to Qaadir or its licensors. Product names and logos of other manufacturers belong to their owners. Links to other websites are provided for convenience, and we are not responsible for their content.
14. Your information
We handle personal information as described in our Privacy policy.
15. Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control, including supplier failures, transport disruption, customs delays, natural events, war, civil unrest, epidemics or government action.
16. Changes to these terms
We may update these terms from time to time. The version on this page when you place an order applies to that order.
17. Governing law and disputes
These terms and any contract under them are governed by the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah. The courts of Ras Al Khaimah have exclusive jurisdiction, unless we agree another forum in writing.
